Will Your Workers’ Compensation Claim Be Dismissed if You Go Back to Work?

If you are like most people, even after you get hurt in the workplace, you’d really like to be working. Accordingly, even when you are receiving workers’ compensation benefits, you may want to try to return to work, to some sense of normality in your life, to see if you can be back in the workplace without pain or discomfort. But you may worry that an attempt to go back to work could put your benefits at risk. How does going back to work affect an existing workers’ compensation claim?

An important caveat—before you attempt to return to your job, always go to your treating physician and get the proper medical clearance. You don’t ever want to put yourself at unreasonable risk of reinjuring or aggravating an old or existing injury.

If you do return to work, you must notify the workers’ compensation insurance company. You must also return or destroy any checks that cover any time after you’ve returned to work.

Once you’ve gone back to work, keep a diary that contains a log of any challenges you face, as well as any days you miss because of the injury or complications from the injury. If you learn that you can’t return to work without discomfort, you can continue to receive treatment, and you can reinstitute your claim, if the discomfort makes it impossible for you to work.
