When you’ve been hurt on the job in New York, you have a right to file a claim through the state’s workers’ compensation system. There are only two requirements—you must show that you were injured and that the injury occurred while you were working. Virtually any type of loss or injury, provided it was incurred at work, will be covered. Let’s look at a few specific types of losses:
- Broken glasses—Though it’s not a bodily injury, it’s still a necessity. If you are involved in a workplace accident and your glasses are damaged or broken, workers’ compensation should pay to repair or replace them.
- Permanent scars or disfigurement—It’s important to understand that an injury doesn’t have to prevent you from working to qualify you for compensation. A scar caused by a workplace accident will typically be considered a permanent partial disability. You will typically qualify for some form of payment.
- A chipped tooth—Again, it’s not an injury that prevents you from working, but if it’s the result of a work accident, workers’ compensation should pay to have it fixed.
- A broken nose—Workers’ compensation is required to pay for all reasonable and necessary medical expenses resulting from a work injury. You should be entitled to payment for any time lost at work because of the broken nose and any medical treatment you seek for the injury.
