Under the New York state workers’ compensation laws, workers’ compensation benefits are generally fixed, based on your average weekly wage for the year prior to your injury. If that’s the case, is it possible to get a significant settlement—a million dollars, for example—if you’ve suffered a serious injury at work? It is! We know because we’ve done it.
We represented a man who had come to America from another country and then suffered a very severe injury. Because of his accident, he was wheelchair-bound and would not be able to work for the rest of his life. He wanted to return to his native country so that he could be close to family, who could care for him.
In our initial discussions with the workers’ compensation insurance provider, we tried to explain the significant needs our client would have for the rest of his life. Nonetheless, the initial offer to our client was approximately $100,000, not enough to take care of his health problems. We refused the offer and kept taking his claim to higher levels within the workers’ compensation insurance company. Because of our determination and refusal to quit, we were finally able to meet with an attorney for the insurer and convince him of the needs of our client. In addition to the million-dollar settlement, we also got our client a new electric wheelchair and airfare to his native country.
This result demonstrates the importance of hiring an experienced and aggressive workers’ compensation lawyer to help you with your claim. Because we knew the law and the process, and because we understood what our client was entitled to, we were able to negotiate an award that covered all his needs.
