In the first blog in this two-part series, we discussed what workers’ compensation, who pays for it and how you qualify to receive benefits. But the more important question, at least for you, is “what should I do when I have been hurt on the job?”

Protecting Your Rights—What to Do When You Suffer a Workplace Injury

The first thing you should always do—no questions asked—get the medical attention you need. If you are unable to move under your own power, don’t try to do so. This will often only make things worse. This is not the time to be brave or to shake it off—for the sake of your health and to protect your legal rights, you need to accept that you’ve been hurt and defer to the medical experts to tell you the extent of your injuries.

Even if you are able to get up and move under your own power, go to an urgent care or see your personal physician as soon as possible.Be sure to tell medical professionals about anything that’s seems out of the ordinary—don’t focus on the obvious injuries to the exclusion of seeming minor ones—it’s often the seemingly insignificant injuries that can be the most debilitating.

Once you’ve received the immediate medical care, notify your employer (your supervisor is fine) as soon as possible. Be sure that you notify your employer within 30 days of your injury or the discovery of your condition. You’ll then need to file a workers’ compensation claim. Before you do, though, it’s in your best interests to hire an experienced workers’ compensation lawyer. The process can be complex and your employer (and/or the workers’ compensation insurance company) may have counsel.
