What Fees Will You Have to Pay to Your Workers Compensation Attorney

If you’ve been hurt on the job and can’t work, you may be considering filing a Workers’ Compensationensation claim. You’re not working, though, so how can you afford an attorney? There’s good news.

When you need to file a work comp claim, you can hire a lawyer without ever having to pay directly for legal representation or legal services. That’s because your attorney will typically handle the claim on a “contingency” basis. That means that, instead of billing you on an hourly basis or charging you a flat fee, your attorney will typically be paid a percentage of the amount you recover in benefits. That amount is determined by the Workers’ Compensationensation judge, who will look at the services provided to you and establish the fee. That’s good news for you, as it provides an incentive for your attorney to do more for you and to get more benefits for you.

Once your claim has been approved and the judge has determined the amount that your lawyer will be paid, that amount will be paid directly to your attorney, so that you don’t have to worry about making payments.

It is important to understand, though, that any out-of-pocket expenses incurred by your attorney must be paid separately. For example, if your attorney must take a deposition and pay for a court reporter, you will need to pay those costs separately.
