If you’ve been hurt at work, your first course of action will be to file a workers’ compensation claim. If you are one of the lucky few, your application for benefits will be granted without a challenge from your employer or the workers’ compensation insurance company. In most instances, though, your claim will be initially denied and you’ll have to ask for a hearing to determine the merits of your claim. What will your attorney need to prepare for that hearing?
The first thing your lawyer will do is obtain medical records from your doctor to identify the specific diagnosis, as well as any tests or treatments you will need. You will most likely be required to submit to a physical examination by a doctor chosen by your employer, but you can also seek care from a doctor of your choice. Make certain you tell your doctor about anything that is out of the ordinary or different after the injury and that your doctor documents everything in writing.
In addition, your attorney will want information on your wages or earnings over the last 12 months, as most workers’ compensation claims are based on a percentage of your average weekly wage for that period. This is typically found on pay stubs or W-2 forms.
When you have received the notice of the hearing, it’s important to immediately contact your lawyer. Your attorney will then most likely schedule a meeting, where you’ll go over all the key issues, including:
- How the injury occurred
- What medical treatment you have sought
- What pain or injuries you have suffered
