Frequently Asked Questions—New York Workers’ Compensation—Injuries Covered

When you’ve been hurt on the job, your first course of action will typically be to hire an experienced workers’ compensation attorney and file a workers’ compensation claim. You may be uncertain if your claim is covered. Are all injuries covered under New York law? In this blog, we look at the general coverage afforded by workers’ compensation benefits, as well as some specific types of injuries.

Q: What does workers’ compensation cover, generally speaking?

A: The New York workers’ compensation laws allow a worker to seek benefits for any injury that has caused temporary or permanent partial or total disability. Benefits are designed to provide a replacement for any income lost, as well as reimbursement of medical expenses reasonably and necessarily incurred as a result of the injury. That includes bodily injury, occupational illness and disease, and psychological injury.

Q: Can you seek workers’ compensation benefits for losses caused by a heart attack or stroke?

A: As a general rule, you can obtain benefits for lost wages and medical expenses after a heart attack or stroke, provided you can show that it was caused in part or in whole by your work environment. While that can be difficult, evidence of significant stress or anxiety may be sufficient to warrant workers’ compensation benefits. In addition, the fact that you had a previous heart attack or that you had a predisposition to heart attack or stroke will not render you ineligible. The Workers’ Compensation Board will look at the question of whether or not conditions at work caused or contributed to a subsequent heart attack or stroke.

Q: Can you recover workers’ compensation for hearing loss caused by work conditions, when the loss developed over a period of time?  

A: Yes. You are entitled to benefits for hearing loss caused by a work event or by repeated exposure to conditions that cause damage to your hearing. You can recover for partial or total hearing loss. In fact, even if you are able to return to your job, you may be entitled to benefits for a permanent partial disability.
