Lifting, Pushing or Pulling Injuries

Recovering Workers’ Compensation for Pushing, Pulling or Lifting Injuries

New York City | Queens | Brooklyn | Bronx Workers’ Compensation Lawyers

It’s one of the most frequent, and one of the most crippling types of injuries—trauma caused by pushing, pulling or lifting something on the job. It may manifest over a period of time, as a repetitive stress or motion injury, or it may be caused by a single event. Most of the injuries associated with lifting, pushing and pulling involve connective tissue, including muscles, tendons and ligaments. These body parts are susceptible to a number of problems, from strains, pulls and tears to significant inflammation. When you’ve suffered any type of injury on the job as a result of pushing, pulling or lifting anything, you have a right to seek benefits through a workers’ compensation claim.

One of the most important things to understand about lifting, pulling and pushing injuries on the job—there’s no requirement that you prove that your employer did anything wrong. The New York workers’ compensation system is essentially a “no-fault” approach, unlike most generic personal injury litigation. There’s no need to demonstrate negligence, recklessness or carelessness by your employer. Instead, you must only show that you were injured, and that the injury occurred while you were working.

When you’ve suffered any type of injury at work while pushing, pulling or lifting something, you want to notify your employer as soon as possible. You can expect to be asked to submit to an independent medical examination, by a doctor selected by either your employer or the company’s workers’ compensation insurance provider. Though that doctor will typically have an incentive to diminish or deny your claim, you have rights, including the right to record the physical examination.
