Should You Hire an Attorney to Handle Your Workers’ Compensation Claim?
You’ve been hurt at work and it’s a pretty clear-cut case. You can complete and file the application for benefits, right? You don’t need a lawyer to help you, do you? At least that’s what the workers’ compensation insurance providers will tell you.
At Pyrros & Serres LLP, we believe it’s always a good idea to have aggressive legal counsel to protect your rights in a workers’ compensation case, especially in light of changes to the workers’ compensation laws over the last few years. One of the most critical changes involves how your case in indexed, and can lead to the denial of a claim, if not done properly.
Indexing a Claim
When you initiate the process, the workers’ compensation board will set up a file for you. In the past, you could index your case simply by filing a medical report. Under new rules, your cases won’t be properly indexed unless the proper notice of injury and medical report are filed together. If your case is not properly set up—with the notice of injury and medical report together—you won’t be able to obtain a hearing from a judge. A skilled attorney understands the new rules and will make certain you’ve complied, so that you can move swiftly to start receiving benefits.
