The Day of Your Workers’ Compensation Hearing—Some Advice

If your initial application for workers’ compensation benefits has been rejected, you will need to attend a hearing to pursue your claim any further. Here are some tips for making the best impression at that hearing.

  • Arrive early—we recommend that you plan to arrive at least a half an hour before the scheduled time. This will help you deal with unexpected delays, such as traffic problems. The worst thing you can do is be absent when the court calls your case. It tells the judge you are not very interested in pursuing benefits. If you show up 10 minutes after the appointed time, it may already be too late.
  • Dress appropriately—Dress comfortably, but not too casually. This is a hearing about serious matters. You don’t need to wear a suit or a dress, but you shouldn’t show up in shorts and tee shirt either. Don’t wear flashy jewelry or expensive watches, and avoid wearing shirts with logos or words printed on them. The court may have a different interpretation of the images than you do.
  • Be responsive, but humble—Your communication with the court is important. Tell the truth—don’t embellish to try to win your case. Answer any questions as honestly as you can and be willing to say “I don’t know,” rather than making up an answer. The workers’ compensation insurance company will usually be represented by an attorney and any false statements you make can easily be brought out and be damaging to your claim.
