Beware of the Bully Investigator

Don’t Be Intimidated by an Aggressive Investigator Hired by the Workers’ Compensation Insurance Company

When you’ve been injured on the job, you have the right to seek benefits through a workers’ compensation claim. It’s important to understand, though, that the workers’ compensation insurance company is a private, profit-driven entity. It’s in their best interests, therefore, to delay, deny or minimize your claim.

One of the common strategies workers’ compensation insurance companies use is to retain a private detective to essentially spy on you. You can expect that they will secretly follow you and attempt to obtain videotape footage of you engaging in activities that indicate you are not injured, or that your injuries are not as serious as you claim them to be. The best solution—be willing to accept that you have been hurt and that the best way you will maximize your physical recovery is to refrain from activities that might aggravate your injury.

It’s also important to understand, though, that the private investigators have a vested interest in finding evidence that supports the workers’ compensation insurer’s position. Don’t be surprised if you are confronted by an investigator who attempts to bully or harass you into making statements that are against your interest. In addition, don’t be surprised if an investigator alleges that you said or did things you didn’t say or do. We represented a client who worked as a maid in the Long Island area and who spoke very limited English. A private investigator hired by the workers’ compensation insurance company alleged in a report that our client made certain statements against her interest. We were able to show in court that our client lacked the skills in spoken English to make those statements, and that the investigator’s report was false.

Your best response when approached by a private investigator—give them the name of your attorney and say nothing more.
