The Regulations Doctors Must Follow When Treating Patients with Workers’ Compensation Claims

When you have been hurt on the job in New York, you have a right to seek workers’ compensation benefits, which include compensation for lost wages, as well as payment of or reimbursement for medical expenses. You will most likely be required to submit to an examination by a company approved doctor, but you can also seek medical treatment from a physician of your choice. There are, however, specific guidelines that your treating doctor must follow.
In 2010, the New York Workers’ Compensation Board enacted new rules regarding the treatment of neck, back, shoulder and knee injuries, among the most common types of workers’ compensation claims. The board is expected to adopt new guidelines regarding other types of injuries as well.
The guidelines set forth the specific levels of care, as well as the types of tests and treatment that are permissible. If a physician believes that a patient needs care that is above and beyond that included in the guidelines, the doctor take certain steps to obtain authorization for the procedure, test or treatment. It’s critical that your doctor knows the correct forms to submit, and knows what needs to be included with the request for treatment, so you have the best chance of a full recovery.
