One of the reasons that the New York legislature enacted the state’s workers’ compensation laws was to put a cap of sorts on the monetary awards injured workers can receive. As a general rule, the amount of compensation is fixed, based on your average weekly wage for the last 52 weeks. But does that mean that there’s no flexibility and that you’ll never be able to recover a substantial award because of the carelessness or negligence of your employer or a co-worker? Not necessarily, as we demonstrated in a case we handled.

We were retained to represent a worker who suffered serious injuries on the job, leaving him wheelchair bound. His family lived outside of the United States and he wanted to return to his native country to live with them, so he could get the care he needed. Because it was clear that he would need significant medical care for the rest of his life, we knew that the standard payout offered by the workers’ compensation insurance company would not be adequate. Initially, the insurance company refused to consider anything more than the standard settlement offer, proposing to pay our client approximately $100,000. We rejected that offer and took our concerns to upper management at the insurance company, successfully arguing to them the need to provide a much higher level of compensation.

As a result of our efforts, our client ultimately received a seven figure settlement, as well as an electric wheelchair and airfare to his home country.
